IDEA BILL Update http://trecenter.org/idea111704.htm http://trecenter.org/idea111704.htm Congress seals special education deal Bill to ensure children with disabilities get same opportunities The Associated Press November 17, 2004 House and Senate negotiators agreed to major changes in federal special education law Wednesday, pressing schools to ensure that children with disabilities get the same opportunities as others. The deal is expected to be widely supported by the House and Senate on Friday and approved by President Bush allowing Congress to squeeze a significant, bipartisan education bill into the final days of its session. The bill aims to boost discipline in class, better identify children who have disabilities, get help to students earlier and reduce lawsuits by parents. It also reaffirms the federal government's intent to pay its share of expenses but does not lock in any yearly commitments. We are judged by how we treat our children, and ... especially by how we treat those children with special needs," said Sen. Edward Kennedy, D-Mass. That is why I believe so strongly in the right of every child to a free and appropriate education. I believe this bill advances that cause. The House and Senate members lauded each other for reaching a bipartisan agreement in a Congress where such cooperation has been rare. The Individuals With Disabilities Education Act, getting its first update since 1997, governs the daily school life of 6.7 million students. After a two-year debate and weeks of negotiations by their staffs, the House and Senate negotiators had only one disagreement Wednesday: whether to give special education teachers an extra year to get "highly qualified. Stricter teacher requirements By the end of the 2005-06 school year, federal law will require new teachers to show competence in every subject they teach by passing tests or getting college degrees. That's considered a huge order for many special education teachers who teach multiple subjects. It's going to be a matter of frustration for so many teachers," said Sen. Jeff Sessions, R-Ala. They're going to be more than frustrated. They're going to be angry. Sessions wanted to push the deadline back to 2006-07, but House members Rep. George Miller, D-Calif., said states gambled and lost if they figured Congress would ease the teacher requirements. Rep. John Boehner, R-Ohio, who led the House-Senate conference, said lawmakers have taken such steps back before and, andquot;We are not going to fail again.andquot; The new law would give new teachers more time to get highly qualified in extra subjects if they met the standard in at least one subject on time. It would also give them more ways to show they know their topics. But that won't ease the pressure in states that have failed to help train teachers or set clear standards, said Kim Anderson, a lobbyist for the National Education Association, the nation's largest teachers union. andquot;Instead of allowing our members the time they're going to need to comply because states were sitting on their hands, they've eliminated flexibility,andquot; she said. "They've slapped the wrong party. The vote was unanimous among House negotiators; one senator, Jim Jeffords, an independent from Vermont, voted against the deal. Overall, the bill strives to improve the early identification of children with special needs, reducing the number of students who are improperly labeled as disabled. The bill also aims to reduce paperwork for teachers; encourage mediation in disputes between parents and schools; and give the education secretary more power to hold states accountable. In another key area, the bill would give schools more flexibility to discipline students with disabilities just like other students, once it is clear that a child's bad behavior is not caused by a disability. Under the deal, Congress will recommit to covering up to 40 percent of the additional costs of educating children with special needs by 2011. Education Secretary Rod Paige called the agreement a giant step toward raising the standards and expectations for all.
